In Kansas, abortion is still legal. In 2019, the Kansas Supreme Court ruled that “a woman’s right to abortion is protected under the Kansas Constitution’s Bill of Rights.” The court said that Section 1 of the Kansas Constitution protects “every person’s right to personal autonomy.” This means that a woman has the right to make decisions about her body, health, starting a family, and family life, including whether or not to keep a pregnancy.
That could change soon. On August 2, voters in Kansas will be asked to approve a change to the state’s constitution. Resolution No. 5003 would “amend the Kansas state constitution’s bill of rights” to say that “abortion is not a constitutionally protected right,” while “reserving to the people the power to control abortion through elected legislators.” When the amendment was approved by both houses of the state legislature, it was put on the ballot in early 2021 under the name “Value Them Both.”
